DMCA Policy
Beyondsoundz.com respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to claims of copyright infringement and to terminate the accounts of repeat infringers.
Notice of Claimed Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information:
1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled.
4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Counter-Notification
If you believe that your content has been removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to us.
The counter-notification must contain the following information:
1. A physical or electronic signature of the content owner or a person authorized to act on their behalf.
2. Identification of the content that has been removed or disabled and the location at which the content appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which (link unavailable) may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.
Procedure
Upon receipt of a valid notice of copyright infringement, we will:
1. Remove or disable access to the allegedly infringing content.
2. Notify the content owner or uploader of the allegedly infringing content of the removal or disabling of access to the content.
Upon receipt of a valid counter-notification, we will:
1. Promptly notify the person who provided the original notification of the counter-notification.
2. Provide the person who provided the original notification with a copy of the counter-notification.
3. Replace the removed content or cease disabling access to it within 10-14 business days following receipt of the counter-notification, unless our designated agent receives notice that the original notifier has filed an action seeking a court order to restrain the content owner or uploader from engaging in infringing activity.
Repeat Infringers
We will terminate the accounts of repeat infringers.
